Alberta Health Services is facing a class action lawsuit and being sued by former staff members over the alleged claim that AHS violated provincial employment standards for close to a decade.
The claim is being made by Clinical assistants (CAs) and Clinical surgical assistants (CSAs) and state that the workers were overworked while being under paid since 2013.
Kahane Law Office is the firm filing the lawsuit.
The firm is seeking $125 million in damages for alleged violation of employment codes including rest periods, shift lengths and overtime payments.
“Since joining Alberta Health Services in 2017, I’ve routinely worked shifts lasting up to 24 hours, including during weekends and holidays,” said Mena Salamh, a plaintiff in the suit. “What we are seeking is proper compensation for the time we have already worked.”
During the period of 2013 to 2022, AHS advised CA’s and SCA’s that they were exempt from receiving overtime pay. according to the lawsuit.
In 2022, that decision was reversed and the group was offered a lump-sum as retroactive payment according to the firm.
According to the statement of claim, filed on April 26th there were 228 active class members involved.
